GENISYS TERMS AND CONDITIONS

1 - What it costs

Our expert advisor Genisys, costs £3,000 as an upfront cost, plus £1,200 annually, to use the licence. The licence is paid in advance, for the following 12 months and once paid, is non-refundable. All prices include VAT where applicable.

The initial charge is £4,200, and upon every subsequent anniversary of the purchase, £1,200 will be charged to renew the licence.

2 - Minimum contract length

The contract is for the writing of the Genisys Software Code plus the first year’s access to your software on our Virtual Private Server (VPS). Access to the VPS is for a period of 12 months and will renew automatically on the anniversary of the contract date. 

3 - Automatic Renewal

Your contract will automatically renew on the anniversary of the contract start date for a further year unless we receive 14 days written notice informing us that you are terminating. 

4 - when does the contract begin

The contract will begin upon successful payment and we will confirm our acceptance by sending you an email confirming the details of your order, our terms and conditions and important information about your right to cancel and any charges you might have to pay.

Please read the confirmation email carefully and check the details are correct. If anything is wrong please tell us immediately by emailing genisys@wealthcreation.group.

Once we have confirmed your order there will be a contract between us.
In accordance with the Consumer Contracts Regulations 2013 we will not start to provide the Genisys coding service for 14 days unless you have specifically asked us to when ordering online. See Effects of Cancellation below at point 8.

Where you have asked us to start coding before the expiry of the 14 day “cooling off “ period, we will endeavour to get your personalised version of Genisys to you within 3 days.

5 - after sales assistance

We are under a legal duty to provide our services to consumers with reasonable care and skill and any digital content should work in the way it has been described to you and must be in conformity with this contract.

We will provide free customer assistance to help facilitate the initial settings up and running of Genisys however where product failure is due to a customer’s actions then a service fee may be applied. This fee could be up to £200 where a full re-code is required.

6 - Complaints

We would ask you to please make any complaint in writing and send it by email to genisys@wealthcreation.group. We will aim to resolve your complaint within seven working days of receipt and where this is not possible we will provide you with an acknowledgement while we investigate further. In all cases complaints are expected to be finalised within 1 calendar month.

7 - your legal rights & how to cancel

If you chose to purchase Genisys from our website you will be entering into to a distance contract for the supply of a service. The Consumer Contracts Regulations 2013 give consumers the right to change their minds when purchasing in this way.

You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 calendar days from the day the contract is confirmed by us, via our purchase confirmation email, or via the date that the stripe order receipt was produced, whichever is sooner.

To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear written statement (e.g. a letter sent by post or email). You may print off and use the attached model cancellation form, but it is not obligatory, and serves only as a helpful example which we are legally obliged to provide.

To meet this cancelation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

8 - effect of cancellation

If you cancel this contract, we will reimburse you all payments received from you no later than 14 days for the date we were informed that you wish to cancel. We will make reimbursement using the same means of payment as used for the initial transaction, unless we have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
IMPORTANT
If you requested to begin the performance of services, during the cancelation period you shall pay us an amount which is in proportion to what has been performed until you have communicated to us your cancellation from this contract, in comparison with the full coverage of the contract.

Where you have asked us to begin providing the service (coding of your Genisys expert advisor) before the end of the 14 day cancellation period and you then decide to exercise your right to cancel, the following shall apply:

Genisys coding not started - A full refund of £4,200 is due.

Genisys coding begun but not complete - A partial refund of £3,200 is due.

Genisys coding is completed - A refund of only £1,175 is due for the unused first year’s licence.

9 - Understanding of the product

We need each user of Genisys to understand these below points. By agreeing to the Terms & Conditions, you are acknowledging and agreeing to the below:

9.1. I understand that spread betting involve a high level of risk to my capital, especially due to their leveraged nature which can easily cause the losses to be greatly magnified.
9.2. I understand what an Expert Advisor is and how it works. (An auto trader is an expert advisor)
9.3. I understand that the Expert Advisor is an unregulated product and does not hold any Financial Conduct Authority (FCA) or Financial Services Compensation Scheme (FSCS) protection.
9.4. I confirm that this product is appropriate for me in the light of my circumstances and financial position.
9.5. I understand that I am in control of and responsible for the inputs and settings of the Expert Advisor.
9.6. I understand that past performance is not a reliable indicator of future returns and that I could get back less than I originally put in. I do not hold The Wealth Creation Group liable for any potential losses.
9.7. I understand that the Expert Advisor comes with no performance guarantees and that I am solely responsible for the actions on my account as well as the execution of the Expert Advisor.
9.8. I understand that no advice is given on whether to open or close trades on my account, I make all decisions of my own free will.
9.9. I by no means hold any external parties accountable for any potential losses experienced on my account while using this product.
9.10.acknowledging that taking professional financial and legal advice from qualified people is the best course of action, prior to purchasing Genisys. 
9.11. I understand that Genisys must run on the in-house Virtual Private Server (VPS)
9.12. I understand that Genisys has been back-tested and optimised for their current Broker, Fusion Markets. If I wish to use my own Broker, Genisys can still be used, but it will not come with any optimisation, problem solving or auto-updates. 
9.13. I authorise The Wealth Creation Group to access my VPS at any given time. I understand settings, updates and general checks / maintenance of the VPS will need to be conducted.
9.14. I understand that the Virtual Private Server (VPS) is a third party platform and is not owned by The Wealth Creation Group. I therefore acknowledge that the VPS can conduct things automatically and I do not hold The Wealth Creation Group liable for any potential losses due to an event outside of their control, within the VPS.

10 - Other important terms

10.1. We may transfer our rights and obligations under these terms to another organisation, and we will always notify you in writing if this happens, but this will not affect your rights or our obligations under these terms.
10.2. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
10.3. You may only transfer your rights or your obligations under these terms to another person if we agree in writing.
10.4. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
10.5. If we fail to insist that you perform any of your obligations under these terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do by e-mail, and that will not mean that we will automatically waive any later default by you.
10.6. These terms are governed by English law. You and we both agree to submit to the non-exclusive jurisdiction of the English courts.
